Twice, Coca-Cola has won lawsuits against PepsiCo over patenting issues. "PepsiCo isn't infringing a patent owned by Coca-Cola," continues the article. U.S. District Judge Richard Story in Atlanta even threw out the case, saying that "Coke has failed to establish a necessary element of its infringement claim against PepsiCo." Twice, Coca-Cola has won lawsuits against PepsiCo over patenting issues. This time, however, PepsiCo's created container "is sufficiently distinct from Coca-Cola's," says the article. According to Pepsi spokesman Dave DeCecco, "It confirms what we knew all along, that there was no infringement."
