Judge Paul Gutman ruled that the siblings failed to prove their case and dismissed it.
The siblings, ranging from 14 to 21 and who accused Extreme, proceeded to file a lawsuit against ABC; however, Judge Paul Gutman ruled that the siblings failed to prove their case and dismissed it.

After both parents died in 2004, the siblings moved in with family friends Phil and Loki Leomiti. Extreme Makeover's producers quickly learned of the children's story and went to work "making over" the Leomitis' home, demolishing it completely in 2005 and building in its place a "nine-bedroom mansion," the article continues.

Later in the year, however, the Leomitis and the siblings had a falling out, and the five orphans moved out. According to the article, "their lawsuit claims the Leomitis engaged in 'an orchestrated campaign' to drive them away by insulting them and treating them poorly."
